The rules of the road of Kazakhstan, approved by the Decree of the Government of the country No. 1196 of 11/13/2013, have changed. This was done by decree of the Government of the Republic of Kazakhstan No. 472 dated June 23, 2015. They have been supplemented and amended.

Reasons for Changes

What caused the new changes in the SDA of Kazakhstan? Any amendment and addition made to the decree of the Government should be based on objective reasons caused by the need to resolve the problems that arose when applying and managing the norms of the document into which they are introduced. The government of the republic explains this step by bringing the traffic rules in accordance with the legislation in connection with the further improvement of the public administration system and taking into account public complaints about some provisions of the current law.

Introducing New Concepts

The traffic fines were revised upwards. Kazakhstan for a long time worked according to the rules established back in the 90s of the last century. Therefore, some provisions in the rules were absent or were presented in a different interpretation.

In the 2013 Rules, some concepts were not given: mass with and without load, irregular carriage of passengers by road, luggage. These definitions were made and approved by the Decree. Changes in the rules of the SDA of Kazakhstan affected the intersection, obstacles to traffic, the main road.

Exclusion of the term “adjacent territory”

Many complaints about some of the provisions of the SDA in force before the introduction of amendments caused the presence of the concept of “Adjacent Territory”. It allowed not to initiate administrative cases of traffic accidents committed in parking lots, gas stations, residential buildings, massifs, and enterprises. This helped to avoid the culprits of responsibility.

In addition, the non-initiation of the case prevented the identification of the person responsible for the transport accident, which made it possible for insurance companies not to pay damages to victims in the framework of compulsory insurance.

New changes in the SDA of Kazakhstan made it possible to solve this problem by eliminating the concept of “Adjacent Territory” from the relevant paragraphs and amending the rules that previously contained this term. Thus, the introduction of amendments allowed injured citizens to receive damages in accordance with the law on compulsory civil liability insurance of vehicle owners.

Use of seat belts

In order to ensure the safety and preservation of the life of drivers and passengers as a result of accidents, amendments were made to the current rules, which will increase the level of use of vehicles.

Prior to the entry into force of Decree No. 472 of June 23, 2015, the republic had rules in place to prevent the use of seat belts for certain groups of drivers, which included taxi drivers, police officers and several others. A change was made to the SDA. In Kazakhstan, now all drivers, without exception, must use belts.

In order to protect pedestrians, amendments were made to preserve their life and safety. Passing through the carriageway is now possible when there are no passenger passages within sight. In other cases, it is imperative to go through them.

Inspector's behavior when stopping the car

Recent changes in the SDA of Kazakhstan establish that the inspector who stopped the car is not required to immediately approach the vehicle and state the reason for the stop. The rules do not specify how long the inspector should come up. He can not explain the reason for the stop, and only after the driver’s question should he give an explanation. At his request, the inspector presents a service certificate without handing it over to the latter.

After stopping the car, the driver and passengers cannot get out of the car without the permission of the inspector. For unauthorized abandonment of the car, a fine is established in the amount of 5 MCI for the first violation, and 10 MCI for the second violation. For reference - 1 MCI equals 1982 tenge. The introduction of this change is associated with increased attacks on inspectors. New paragraphs of rules allow to secure their work.

Headlights on

Another item is included in new changes in traffic rules. In Kazakhstan, a ride is established with headlights constantly on. It can be a dipped beam, running daytime running lights, fog light. The rule is valid throughout Kazakhstan. The penalty for failure to comply with this paragraph is 5 MCI for the first violation, and 7 MCI for the second violation.

What caused this innovation? According to the research, the car with the headlights on is better visible, which reduces the risk of collision of vehicles. This is especially important during bad weather and fog, which is quite justified in the conditions of highlands.

Inspection deadline

The latest changes in the SDA of Kazakhstan were introduced taking into account the quality of the cars and the fact that the owners regularly carry out scheduled repairs. Based on this, the duration of the ride without inspection was increased.

Cancel issued power of attorney

According to the old rules, driving a car that did not belong to the driver personally was only possible with a notarized power of attorney. This does not require a new change in the SDA. In Kazakhstan, it is now sufficient to present the usual written power of attorney from the owner of the car. This item will save you from bureaucratic red tape on drawing up a power of attorney and will save money.

While driving, the driver must have rights, insurance for transport, vehicle registration certificate. The power of attorney did not play a special role before: if the car is in theft, then the hijacker does not have the above documents.

Child transportation

Now transporting children under 12 years old without a special device that holds the child is prohibited. This does not mean that a car seat must be installed in the car. It is enough to fasten the child with special belts adapted for fixing and holding the baby in the seat. Most importantly, the child should be fastened.

Boarding and disembarking passengers in designated areas

Another interesting change in traffic rules. In Kazakhstan, passengers should now be disembarked from vehicles only at specially designated stopping places. Previously, this concerned public transport, now it is necessary for all cars. This item caused a lot of disagreement, as special stopping places are intended exclusively for public transport. Stopping them, especially in big cities, with a large number of buses, trams, trolleybuses, minibuses, is a difficult task that entails unpleasant consequences, as any traffic violation is punished with serious fines. Kazakhstan asks once again to clarify this norm.

Driving a vehicle

The old rules provided a list of roads that prohibited driving in training vehicles. On all roads not included in this list, it was possible to travel by car with a cadet. Now the Government of the republic is coordinating the list of routes drawn up by the authorized body for which it is allowed to travel on training vehicles.
